Indigent Legal Defense Counsel
INVITATION TO PROVIDE PROPOSALS: Fillmore City (“City”) is accepting proposals from qualified attorneys who are interested in providing indigent legal defense counsel in the Fillmore City Justice Court (“FCJC”). It is anticipated that other than trials or evidentiary hearings, all hearings will be conducted via WebEx. The current schedule for FCJC is the fourth Thursday of every month. Currently, about one to five new defendants are appointed indigent counsel each month.
DUTIES & RESPONSIBILITIES:
Upon assignment by the court, the attorney or firm will act as court-appointed counsel to indigent adults charged with crimes. Legal services and representation duties include the following:
2.1. Serve as court-appointed counsel for indigent criminal defendants and other persons in cases who are entitled by law to assistance of counsel as defined in the Indigent Defense Act further defined in Utah Code Annotated 78B-22;
2.2. Prepare and appear with clients at all pre-trial and trial proceedings and hearings:
Obtain formal and informal discovery;
Interview clients to evaluate evidence and assess strength of case;
Develop a theory of the case;
Research legal issues;
Analyze charging documents, police reports and discovery material and evidence;
Draft, file, and argue appropriate motions;
Negotiate settlements or changes of plea;
Prepare trial briefs and conduct all phases of trial in court, including jury trials;
Recommend bond and participate in bond hearings;
Review petitions for probation revocations and participate in sentencing hearings; and,
Prepare motions for a new trial if necessary.
2.3. Maintain adequate and proper records of the representation for each assigned indigent defendant; and
2.4. Keep current with the statutes, rules, and cases regarding both procedural and substantive legal issues.
2.5. Spanish speaking is a plus, but not a requirement.
2.6. Maintain licensing to practice law in the State of Utah and be a member in good standing with the Utah State Bar.
2.7. Current malpractice insurance.
APPLICATION REQUIREMENTS & SUBMISSION
3.1. Submissions should be prepared simply and economically, providing a straightforward, concise description of provider capabilities to satisfy the requirements of the request. Emphasis should be on completeness and clarity of content.
3.2. All submissions must include the following:
The applicant’s resume;
A letter of interest that includes a fee proposal, whether flat fee, an hourly rate, or a combination of both;
References (minimum of 3) with contact information;
A plan or proposal addressing conflicts of interest, and;
Statement acknowledging the applicant is in good standing with the Utah State Bar and maintains legal malpractice insurance.
Resumes, letters of interest, and references must be sent, via email, to Kevin Orton, Fillmore City Recorder at recorder@fillmorecity.org.
Any questions about this RFP may be submitted, in writing prior to May 9, 2025; however, all questions and any responses will be provided to all parties that have expressed any interest in submitting a proposal.
Proposals should be submitted on or before May 13, 2025.
4.0 SELECTION PROCESS.
4.1 Proposals shall be evaluated according to the following criteria:
Experience in similar positions;
References;
Ability of Applicant to meet the requirements of the work to be performed within the City’s desired schedule and availability of adequate personnel;
The amount of the proposed fees and cost;
Presentations by Applicants may be requested by the City Council with the purpose of allowing the invited Applicants to present qualifications, past performance, and allow the City Council to ask questions.
4.2. The City reserves the right to:
Issue addenda to the RFP, including extending or otherwise revising the timeline for submittals;
Withdraw the RFP;
Request clarification and/or additional information from the Applicant at any point in the procurement process;
Execute a contract, or contracts, with one Applicant on the basis of the original proposal or any additions to proposal submissions;
Reject any or all RFP’s or any part, thereof;
Waive informalities;
Negotiate and agree to contract terms with the successful proposal; and/or
Disregard non-conforming, non-responsive, unbalanced or conditional proposals, and to re-advertise if it is in the best interest of Fillmore City to do so.
